GOZAL APP – Terms & Conditions

1) Overview & Agreement to Terms

These Terms & Conditions ("Terms") govern your access to and use of the GOZAL APP website, mobile apps, and related services operated by GOZAL APP LLC ("Company," "we," "us," "our") that enable third‑party service providers to offer their services to Clients (collectively, the "Platform").

By accessing or using the Platform, creating an account, or clicking "I agree," you agree to be bound by these Terms and our Privacy Policy and Service Provider Policy (together, the "Agreement"). If you do not agree, do not use the Platform.

3) Eligibility & Accounts

3.1 Age

You must be at least 18 (or the age of majority in your jurisdiction) to create an account.

3.2 Account Information

You must provide accurate, current, and complete information and keep it updated. You are responsible for all activity on your account and for safeguarding your credentials.

3.3 One Account; No Transfer

Accounts are personal (or assigned to a legal entity you represent) and may not be transferred or shared without our permission.

4) Platform Role

4.1 Platform Provider

We provide the Platform that connects Clients and Service Providers. Contracts for sale are between Clients and Service Providers, not with GOZAL APP LLC.

4.2 No Warranty of Service Provider

We do not check the quality and/or level of service and/or professionalism of Service Providers; we do not guarantee Service Providers or Listings, and disclaim liability as allowed by law (see Section 18).

5) Service Provider Onboarding & Verification

5.1 Service Provider Information

Service Providers must provide accurate legal identity, contact details, business registration numbers (where applicable), and any compliance attestations we request.

5.2 Verification; KYBC

We may (but are not under any obligation to do so) verify Service Provider information (including by third‑party checks) and may request supporting documents before or after Listings go live. We may suspend or remove Service Providers or Listings that fail verification or violate these Terms.

6) Listings & Prohibited Items

6.1 Accuracy

Service Providers must ensure Listings are truthful, non‑misleading, and include required disclosures (price, taxes, shipping, material characteristics, safety info, warranties, etc.).

6.2 Compliance

Service Providers are responsible for ensuring items comply with applicable laws.

6.3 Removal

We may remove any Listing at our discretion.

7) Pricing, Fees & Taxes

7.1 Prices

Service Providers set prices. All amounts must be displayed in [currency] and include or clearly exclude taxes/fees as required by law.

7.2 Our Fees

We may charge Service Providers commissions, listing fees, payment processing fees, or other charges as described in our Fees Schedule. Fees are non‑refundable except as required by law.

7.3 Taxes

Service Providers are responsible for determining, collecting, reporting, and remitting applicable taxes (e.g., VAT/GST/sales tax). Where required by law, we may withhold or collect taxes and remit on a Service Provider's behalf or provide tax calculation tools.

8) Reviews & Ratings

Users may leave reviews that must be fair, accurate, and based on genuine experiences. No fake or incentivized reviews. We may moderate, remove, or flag reviews that violate policies or the law.

9) Privacy & Data

Use of personal data is governed by our Privacy Policy. Service Providers are independent controllers of Client data they receive to fulfill Orders and must comply with applicable data‑protection laws (e.g., provide a privacy notice, use data only for Order fulfillment unless obtaining consent).

10) Disclaimers

To the maximum extent permitted by law, the Platform and all content are provided "as is" and "as available" without warranties of any kind (express or implied), including merchantability, fitness for a particular purpose, title, or non‑infringement. We do not warrant uninterrupted or error‑free operation.

11) Limitation of Liability

To the fullest extent permitted by law, we are not liable for: (a) indirect, incidental, special, consequential, or punitive damages; (b) lost profits, revenues, data, or goodwill; and (c) issues caused by Service Providers or third parties.

Our total liability for any claim will not exceed the greater of (i) USD [10] or (ii) the fees you paid to us in the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations; in such cases, limits apply to the maximum extent permitted.

12) Indemnification

You will indemnify, defend, and hold harmless GOZAL APP LLC, its affiliates, and personnel from any claims, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your content; (b) your Listings or items; (c) your breach of this Agreement or law; (d) disputes with other Users.

13) Suspension & Termination

We may suspend or terminate accounts/Listings immediately (with or without notice) for suspected fraud, policy violations, legal risk, or to protect Users. You may close your account at any time; certain obligations (e.g., fees owed, warranties, refunds, IP, indemnities) survive termination.

14) Changes to the Terms

We may update these Terms. Material changes will be notified by email or in‑product. Changes are effective on the Effective Date shown above. Continued use after the Effective Date constitutes acceptance.

Official notices to GOZAL APP LLC must be sent to legal@gozalapp.io and 8902 Kettle Drum, Boynton Beach, FL 33473.

17) Miscellaneous

If any provision is invalid, the remainder remains in effect. We may assign this Agreement. You may not assign without our consent. No waiver is implied by delay or failure to enforce.

Annexes

Annex A – Service Provider Policy (Binding on Service Providers)

A1. Listing Standards. Provide accurate titles, images, specs, variations, and required safety/warning info. Disclose total price (including taxes/fees) and delivery times.

A2. Order Fulfilment. Ship by promised date; provide tracking. Keep inventory accurate.

A3. Returns/Refunds. Honor Platform policy and mandatory laws (cool‑off periods, defects). Provide a returns address in the destination region if required by law or state who pays return postage.

A4. Product Safety & Recalls. Ensure items meet applicable safety standards; cooperate with recalls/withdrawals and notify Clients promptly.

A6. Communications. Use Platform messaging; no off‑platform solicitation that circumvents fees.

A7. Data Use. Use Client data only to fulfill Orders and as permitted by law and the Privacy Policy.

A9. Audit & Information Requests. Provide documentation we reasonably request (invoices, safety certifications, authorizations).

A10. Enforcement. We may remove Listings, hold funds, suspend accounts, impose penalties described in the Enforcement Policy (https://www.gozalapp.io/terms), and cooperate with authorities.
